Eric, you are missing nothing. You have it exactly right.
Here is the FIA release of the Q&A of Max Moseley, FIA President. He states 
the facts surrounding this unpleasantness and explains, with clear examples, 
precisely why the FIA could not change its rules to accommodate mistakes in 
equipment and preparation:
