thank you very much dear Bryan.

after having seen the images thanks to ric carter,
i am less worried that the photographer will lose.
they are all right at an open window where no expectation of privacy exists.
in plain sight.
even without the telephoto lens there would have been a photo.

i think the family's lawyer is depending on the fact that
unlike philip lorca-decorcia this photographer was not standing on public
land
and the subjects were not standing on public land.
but plain sight is still plain sight, especially in new york courts.

there are innumerable apartments at eye level with train lines for example.
if you want privacy, keep the curtains closed.

and clearly these are art prints.
