Ted -

Once a photo is in digital form, which it has to be to appear on the 
internet, it should have metadata included in the file info.  This is 
what the Orphan Works bill is all about.  If the photo doesn't have 
metadata, it is assumed to be an "orphan" and anybody can use it 
without compensating the photographer.
