The problem is that it is impossible for society to function if all principles
of intellectual property are respected to the letter.  Conversely, it is
difficult for some people to make a living if intellectual-property principles
are not respected at all (except for software developers, apparently--they have
no rights to anything that they didn't write using their own resources
exclusively).  And there are no statutory guidelines for distinguishing between
these two conflicting interests, so every case involving intellectual property
is a roll of the dice, almost.  Whoever can afford the best lawyers wins
(although that is not limited to IP disputes, of course).
