This only applies to Quebec and not the rest of Canada. ted --> The case reached the $upreme Court of Canada. Some girl got her picture taken by a "street photographer" who published it in a low circulation media, around 1000 circulation, I understand. The girl showed the picture to friends who derided her. She went to 'dad' and got him to put up the monies for a "breach of privacy" case, and a quite good lawyer if we judge the results. For the time being, it's a no-no to shoot strangers in Quebec if ANY form of publication is considered, even in an art museum... You must go up to them and ask for a release in writing. I don't know how the case was argued, but it makes street photography or the unauthorized publication of such a photo a serious liability. I also wonder how it is that the National Assembly has not interfered with this situation yet to set the rules from Parliament rather than from the courts. Be VERY CAREFUL with this situation.
