I would give the seller the benefit of the doubt. They may have had a 
family emergency or lost access to the net (PC could have crashed, etc...) 
Also the USPS is insanely busy right now and the shipping may be delayed. 
Does the seller have any negatives on file? If yes, then begin to worry, 
give it another week and hit them with bad feedback.

If you get your checks back from the bank, you may be able to get the 
sellers bank information and pursue legal remedy there.

Most likely, however, it is just a delay. A number of times I've been ready 
to blast someone's feedback for non delivered merchandise only to have it 
arrive in the mail that day. As you know the vast majority of eBay sellers 
want good feedback to ensure further business. eBay can be abused but it 
takes work and most dishonest folks aren't willing to put in that level of 
effort.
