Even if it was, it's no problem for me.
W. Gene Smith had a clause in his contract which stipulated no flash  
use.
On that shot of Schweitzer, at the table with a light, Smith popped a  
flash off the floor to light the background.
They do what they had to do to fill whatever requests, needs, etc.
