Yes, that is what the bill does.  I have been working for changing 
it, too, and so have all of the photographers' organizations I belong 
to, but the whole point is that this is not a good bill for anybody 
who depends on and respects copyright.  ASMP has been working since 
the last terrible bill was tabled.  They did manage to get the bill 
changed to exempt commercial works from being available as free 
Orphan Works; however, in the negotiations ASMP says that they had to 
make concessions and the concessions affect me and all other 
editorial photographers:

"In a nutshell, we see little financial harm to creators from the 
non-profit and non-fiction uses of orphaned images. At the same time, 
we want to make sure that commercial users of images and 
illustrations would not be able to use an Orphan Works defense as a 
free pass to profit from infringements."   ASMP

I have spent 30 years trying to convince non-profits that 
photographers should be paid for their work.  This bill says otherwise.
