The photograph of the person is associated with a product or service. If you use the photographs personally, or for editorial use, as in text books, coffee table books, magazine articles, gallery show, and the like, no release is needed. You are not associating the person (or property) with an endorsement. Having said that, it is not always as cut and dried as I stated. As with anything, there are gray areas. When in doubt, get a release. Generally, artistic and editorial use does not need a release. Unless the photograph is derogatory in nature.
