You can still take a picture of anyone you want in a public place. You just may not publish it in any way (even news/editorial) without their permission - which, of course, may be sought afterwards. "The right to one's image is an element of the right to privacy under s. 5 of the Quebec Charter. If the purpose of the right to privacy is to protect a sphere of individual autonomy, it must include the ability to control the use made of one's image. There is an infringement of a person's right to his or her image and, therefore, fault as soon as the image is published without consent and enables the person to be identified." Of course, TV news has an easy way of doing it - subject is on camera and they are asked if the agree to be recorded for TV - and it's all there on tape (or digital...) Tim A
