I think that normal news and photojournalism uses are fine. The case involved a indirect photograph of a person sitting at the side of the street which was represented to be a "problem" in a feature story. The photographer did not ask permission nor for any personal details of the subject. I think it was wrong to use the photograph as they did. Again I am not particularly familiar with all the ins and outs of the decision and would welcome any clarification and correction.
