Tina,

With respect to your concerns about having a site offer your link at their
site, I did a quickie consultation with an attorney who does intellectual
property rights work for people in the computer industry. His response is
below:

"Very good questions. No definite answers. There are a variety of legal
theories to pursue, including trademark, maybe copyright, unfair business
practises under state law, etc. Lots of potential weapons, but all she can
actually do is (1) ask that the link be discontinued, and if that doesn't
work (2) sue, coming down like a 16 ton hammer. That, alone, regardless of
the specific theories she uses, will obtain the relief she seeks. Like many
other legal questions, the ultimate question is only this: Does she have the
dollars to pursue the issue? One last avenue: Go to the site operator or
other host, and see if they will do something."
