However, if the photographs he took that evening were to be used in any commercial way, and there was a standing professional agreement between the two, (and IF he knew she was taking meds and continued whatever play acting may have put additional stress on an addled body), would he not be responsible for his model's safety while in his employ? Conjecture at this point, but the employee/employer relationship issue may be the toughest hurdle for him, particularly with photographic documentation.
