Easy, Ted. Collect from sellers. This is what happens in California. I was audited once and had a sales tax fellow in my studio for a week and a half going over every invoice, every receipt, even FedEx records to prove out of state sales. And he found $300 he disallowed (wonderful word!). We also have "Use" tax, meaning that if I buy from out of state for my business, I have to pay a "use" tax equivalent to the sales tax. The auditor did give me one tip, however. By fluke I had always included the phrase "use right granted upon payment in full" on the invoice. This means the contract isn't valid and fullfilled until payment made, so sales tax not due until paid. Without that phrase, the sales tax would become payable upon invoicing, whether you run your books by cash or accrual. And we think taking pictures is hard work. donal - -- Donal Philby San Diego http://www.donalphilby.com
