Martin,

Tina and Greg pretty much covered it all.  When possible (or when in =
doubt) always obtain a Model Release, even if it's a pocket release. It =
may not offer the same protection, but it's better than not having one =
at all.
The line is pretty blurry -- a photo used for the cover of a magazine =
could be considered to be for commercial use since the image is used to =
sell/advertise the magazine (even though it's unlikely to happen).
There is an interesting article on the subject of editorial/commercial =
usage by Collin Jacobson, "Magnum Farce" (I hope it's still current and =
accessible).
